Terms of Service

1. Introduction
Welcome to gestuo ("we", "our", "us"). These Terms of Service govern your use of our platform at gestuo.com. By accessing or using gestuo, you agree to be bound by these terms.
2. Service Description
gestuo is a curated digital marketplace connecting customers with vetted artists for bespoke art commissions. We facilitate introductions, handle payments, and provide tools for collaboration. Artists retain full creative control over their work.
3. Accounts
You must be at least 18 years old to create an account. You are responsible for maintaining the security of your account credentials. You agree to provide accurate and complete information when registering. We may suspend accounts that violate these terms.
4. Commissions & Payments
All commissions are subject to artist acceptance. gestuo charges a 10% platform fee on the base price. Payments are processed securely through Stripe. Artist payouts are subject to successful Stripe Connect onboarding and completion of commission terms.
5. Three-Tier Model
TIER 1 (Digital Concept, £15–£200): standalone digital download via signed URL. TIER 2 (Physical Print, £40–£600): physical production and shipping via Printful. TIER 3 (Original Commission, £150–£10,000): bespoke original work with up to three revision rounds, 30% deposit, balance on delivery.
6. Intellectual Property
Artists retain all intellectual property rights to their original artwork unless explicitly transferred in writing. Customers receive usage rights as specified in the commission agreement. AI-generated briefs and suggestions are not considered artwork and may not be claimed as such.
7. Refunds
Refund eligibility depends on the commission stage: full refund before concept creation, partial refund after concept delivery (artist and platform mediated), and no refund after final artwork delivery. Disputes may be escalated to gestuo for mediation. Our decision in good faith is final.
8. Prohibited Conduct
Users must not misuse the platform, attempt to circumvent payment systems, submit fraudulent content, harass other users, or infringe intellectual property rights. Violations may result in account suspension and forfeiture of funds.
9. Limitation of Liability
gestuo is provided "as is" without warranties. Our liability is limited to the amount paid in platform fees for the disputed transaction. We are not responsible for the quality of artwork produced by artists, though we will mediate disputes in good faith.
10. Changes to Terms
We may update these terms periodically. Material changes will be communicated via email at least 30 days before taking effect. Continued use after the effective date constitutes acceptance of updated terms.
11. Governing Law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
